| Title | Non Payment Of Remaining ($4,500) 50% of contract and Run Away |
| Description | Ignite Search: On 24th March (Cyberaas) has refused to answer/engage with any of our multiple instances to contact him. All methods of private communication with Justin and Cyberaas.io has been exhausted to date. Last contact from him was mid Jan 2023, and that was an autoresponder email. Last reply from him via WhatsApp is 3/1/23. - Filed in 20th Mar 2023. 1. As mentioned, the brand guidelines was successfully completed prior to commencement of the website development project; in fact, the project was actually very enjoyable and everyone including Justin was happy with the outcome. 2. On the note of project delay for the website, we have been more than accommodating. To paint the picture, the website development project contract was signed on the 2nd December 2021, was originally supposed to be completed in 4 weeks. Let's just say it's been quite some time since then. 2. On the note of payment terms, contrary to what was stated, terms for remaining 50% payment was actually much earlier in the project; it was goodwill on our part to allow Justin more time to get the necessary input, as per point 2. 3. On the note of the state of the website; the website was all complete and ready for launch, in December 2022. Cyberaas Reponse: I engaged Cheech from Ignite to do Cyberaas website. Agreed payment terms are 50% upon kickstart and 50% upon project completion. I paid the 50% kickstart money. I have been delaying the project and the progress is slow due to busy schedule. This is my fault. I understand he wants to close the project asap. But u can't just force bill your customer and chase for payment when the project is not completed. I told him I'm really tied up with works and have a newborn coming at that time. He continued to chase payment for unfinished project when I'm on paternity leave. This is a terrible way to treat your customer. I can't accept this. I'm doing business too, and I have projects that drags for years, and still, I won't do this to my customers. It's not professional and spoilt the relationship. In conclusion, I do not want to work with him anymore. I accepted the consequence that I paid 50% of the project money and get no website. Btw, Ignite had done a branding project for Cyberaas. No issues on that. Project was completed and delivered. 100% of that project money paid. I'm exiting the group because I don't want to waste time on meaningless agruments. No point. In his books, probably, I'm an asshole. In my books, it's a terrible customer experience. OPSD Reasoning 1) Ignite search has produced the work and has an establish contract in place. While customer side delays are expected, vendors have expended cost to deliver a project and need to make their cash flow. 2) The reason of being tied up for work is not a sufficient reason for non payment. 3) The upgrade to a black strike is due to Justin Ooi refusing to mediate the matter and running away. The OPSD feels this is non constructive. The OPSD has several methods to remedy the issue including escrow or abandonment settlement but due to Justin and Cyberaas non-engagement we are unable to remedy this. |
